I Introduction

These General Terms and Conditions for the Sale of Goods (hereinafter: Terms) regulate the conditions for purchasing goods online and paying for goods, delivery methods, conditions and timeframes, and the right to claim for purchased goods.

 

After reading these Terms and accepting them by clicking the designated checkbox and continuing with the purchase through the online portal: https://coffeeroastingman.rs/ you confirm that you understand and fully agree with the Terms.

 

The online store on the portal https://coffeeroastingman.rs/ is exclusively owned by the company “MARJAN NJEGRIĆ PR CRAFT TRADING AND CATERING BUSINESS COFFEE ROASTING MAN KIKINDA” from Kikinda, Đoke Radaka St. No. 8, MB: 52246059, PIB: 100509522, which reserves the right to make changes or additions to these Terms without prior notice. After changes or additions, the revised Terms will be available on the online portal, and you will be able to familiarize yourself with them at any time.

 

Therefore, we kindly ask customers to read our Terms again before each purchase.

II Definitions

Seller – “MARJAN NJEGRIĆ PR CRAFT TRADING AND CATERING BUSINESS COFFEE ROASTING MAN KIKINDA” from Kikinda, Đoke Radaka St. No. 8, MB: 52246059, PIB: 100509522.

 

Buyer – A buyer is any visitor to the online portal https://coffeeroastingman.rs/ who selects at least one product, adds it to the cart, places an order, and pays for the item through one of the methods described in Chapter III.

 

To make an online purchase through the above portal, you must be of legal age.

 

Online Portal – The online portal of “MARJAN NJEGRIĆ PR CRAFT TRADING AND CATERING BUSINESS COFFEE ROASTING MAN KIKINDA” available at: https://coffeeroastingman.rs/ The portal is available in both Serbian and English.

 

Goods – Products available on the online portal, under the products section.

 

Courier Service – Post Express – Serbian Post.

III Prices

All prices listed on the online portal are clearly indicated under each product, and depending on whether the Serbian or English version of the portal is used, the prices are displayed in dinars (RSD) or euros (EUR), all inclusive of VAT. Prices in EUR are listed for international customers, where the purchase is made by converting EUR to RSD via the “Banka Intesa” bank at the exchange rate of the National Bank of Serbia (NBS) on the day of purchase.

The listed prices do not include delivery costs, i.e., the price does not cover the courier service fees. The courier service cost is calculated when the product is selected and moved to the customer’s cart for payment. In addition to the product price, the courier service fee will be added to the total cost that the Buyer will be charged.

Product prices are subject to change, but the Seller will publicly announce any changes on the online portal. Changes in price do not affect previously ordered goods at the price that was indicated on the portal at the time of the order.

The Seller does not determine the delivery costs charged by the courier service and is not responsible for price changes by the courier service.

IV payment methods

The payment for ordered products can be made in several ways:

  • Payment by Card (VISA, Maestro, MasterCard, American Express, and possibly other cards available in the Republic of Serbia)

When ordering, payment can be made by entering card details in the designated fields. The Buyer will be automatically redirected to the Online Payment module of “Banka Intesa”, where the payment will be processed.

 

Card payments are made on a secure page of the bank, through the internet using encrypted SSL protocol and PKI system. At no point does the Seller’s system have access to the Buyer’s card details, so the Seller, i.e., “MARJAN NJEGRIĆ PR CRAFT TRADING AND CATERING BUSINESS COFFEE ROASTING MAN KIKINDA”, cannot be held responsible for any misuse of card data.

 

Payment by card is available for both domestic and international purchases.

 

  • Cash on Delivery

When selecting cash on delivery, the Buyer can pay for the order in cash upon delivery to the courier service. Cash on delivery is available only for orders within the Republic of Serbia and is not available for international orders.

 

  • Payment via Bank Transfer

As a final payment option, the Buyer can pay for the ordered goods by making a transfer to the Seller’s current account, with the required reference number generated during the order. Payment must be made before the goods are shipped.

 

The payment can be made via a payment order at any post office or bank in the Republic of Serbia, as well as at currency exchange offices with payment systems, or at relevant financial institutions abroad.

 

Upon receipt of the payment in the Seller’s account, the conditions for delivering the goods are met.

V Ordering and Payment for Goods

Goods are ordered by accessing the online portal https://coffeeroastingman.rs/ or the sales section, where all available products are displayed at the time of ordering.

 

By clicking on the desired product, the product specification is displayed to inform the Buyer about the details of the goods they wish to order. Below the product specification, the Buyer can select the desired quantity and add it to the cart.

 

After selecting all the desired products, the Buyer clicks on the cart preview to access the part of the portal where they can remove products if they no longer wish to buy them or continue to payment by entering the required details (name and surname, optional company name for businesses, country, street and house number, city, postal code, phone number, and email address), selecting the payment method, and clicking on the “order” button.

 

The order total includes the courier service fee, which is paid together with the price of the selected product. If payment is made by card or via bank transfer, the courier service cost is paid immediately. If payment is made via cash on delivery, the payment is made upon receiving the goods.

After completing the order and payment (if the payment was made by card or bank transfer), an invoice will be sent to the provided email address. If the Buyer provides incorrect details or an incorrect email address, the invoice will not be delivered.

VI Method, Conditions, and Delivery Deadlines

The seller is obligated to ensure the delivery of purchased goods to the address specified by the buyer. The buyer guarantees that all entered data is accurate and assumes responsibility for any incorrect data entry.

 

The seller reserves the right to contact the buyer via telephone or in writing (by sending an email or letter to the provided address) to verify the data entered in the order. In case of suspicion regarding the accuracy of the data or if the entered information cannot be verified, the seller reserves the right to cancel the order and will notify the buyer appropriately, if possible. The buyer and seller will then agree on how to refund any payment made if applicable. If the seller cannot contact the buyer due to incorrect data, and payment has been made, the seller will refund the money to the account from which the payment was made.

 

For the seller to deliver the goods, the buyer must pay the full amount as described in sections IV and V, except for goods paid on delivery. The total amount includes both the product cost and the delivery service cost.

 

Delivery is made within the entire territory of the Republic of Serbia and internationally by authorized persons or courier services appointed by the seller. The seller is obligated to ensure that goods are delivered in their original packaging.

 

For international deliveries, additional costs may apply, such as import/export fees and customs charges, for which the seller is not responsible; these costs are the buyer’s responsibility. The seller is only obligated to provide the necessary documentation for customs clearance in the destination country.

 

The seller commits to sending the ordered goods by courier to the provided address no later than 48 hours after receiving the order. This deadline may be extended for valid reasons, and the buyer will be notified accordingly. The delivery deadline is determined by the courier service in accordance with its business policies and legal regulations, which means the seller cannot influence the delivery time.

 

If delivery is not possible due to the buyer’s fault, the seller has the right to charge the buyer for the real costs incurred during a reattempted delivery. The courier service will provide proof of attempted delivery, which will include the details of the attempt.

 

When receiving the goods, the buyer must inspect the package, as later complaints regarding quantity or damage will not be accepted. If the buyer notices any damage or discrepancy in the quantity upon receipt, they must promptly notify the seller; otherwise, the seller will not be liable for such issues.

For international deliveries, the seller is not responsible for any customs inspection or sample-taking that may occur, as this can be part of the customs procedure, and the seller will not bear any associated costs.

VII Conformity of Goods and Right of Withdrawal

If the delivered goods are damaged, not the correct type, or the quantity does not match the order, the buyer has the right to complain.

 

If the delivered goods do not conform to the contract, the buyer who has informed the seller of the non-conformity may demand that the seller rectify the issue by replacing the goods, providing a corresponding price reduction, or canceling the contract regarding the goods.

 

If the non-conformity cannot be corrected by replacement, the buyer has the right to request a price reduction or contract cancellation if:

  • The non-conformity cannot be rectified by replacement at all or within a reasonable time;
  • The buyer cannot claim a replacement, or if the seller does not make the replacement within a reasonable time;
  • The replacement cannot be carried out without significant inconvenience for the consumer due to the nature of the goods;
  • Correcting the non-conformity through replacement represents an unreasonable burden for the seller.

 

The seller is not liable for non-conformity if the buyer was aware of or could not have been unaware of the non-conformity at the time of concluding the contract.

 

The goods will be considered in conformity with the contract if:

  • They match the description provided by the seller;
  • They are fit for a particular purpose known to the seller or that the seller should have known at the time of concluding the contract;
  • They are fit for regular use of goods of the same type;
  • In terms of quality and performance, they meet the standard expectations for goods of that type and what the buyer can reasonably expect, based on the nature of the goods and public representations made by the seller, especially if those representations are made on the packaging.

 

The buyer can notify the seller of non-conformity via:

  • Sending an email to prodaja@coffeeroastingman.rs (for buyers from Serbia and abroad).
  • Calling 062 500 393 (for buyers in Serbia).

 

The seller will address the non-conformity by replacing the goods or providing the missing items, with the exception of international deliveries and opened packages during import/export procedures.

 

The buyer must provide a fiscal receipt or invoice when making a complaint about non-conforming goods.

VIII Right of Withdrawal

According to the Consumer Protection Act (“Official Gazette of RS”, No. 88/2021), the buyer has the right to withdraw from the contract within 14 days from the day the product is delivered to the buyer or a third party designated by the buyer, excluding the carrier.

 

The consumer may withdraw from the contract by submitting a specific withdrawal form. The buyer is not obligated to state the reasons for withdrawal. The buyer must return the product without delay and no later than 14 days from submitting the withdrawal form. The buyer bears the direct costs of returning the goods in case of withdrawal. After 14 days from the withdrawal request, the product cannot be returned, nor can the contract be terminated. Only unused, undamaged products with all accessories and documentation may be returned, and the fiscal receipt/invoice must be provided. The returned product must be in its original packaging and without visible signs of use; otherwise, the buyer has no right to withdraw from the contract. If the product is damaged due to improper handling by the buyer, the return of funds will be rejected, and the product will be returned at the buyer’s expense.

 

In the case of a lawful withdrawal, the seller is obligated to return the amount paid by the buyer without delay, and no later than 14 days after receiving the withdrawal request. The seller may delay the refund until the goods are returned or the buyer provides proof of sending the goods, whichever comes first.

IX Currency Conversion

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informational display of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used.

The amount charged to your payment card will be expressed in your local currency through conversion at the rate used by card organizations, which is not known to us at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price stated on our website.

X Refund Policy

In the case of returning goods and refunding the customer who previously paid with one of the payment cards, either partially or in full, regardless of the reason for the return, “MARJAN NJEGRIĆ PR ZANATSKA TRGOVINSKA I UGOSTITELJSKA RADNJA COFFEE ROASTING MAN KIKINDA” is obligated to process the refund exclusively through VISA, EC/MC, Maestro, Amex, and Dina payment methods. This means that the bank, upon the seller’s request, will process the refund to the cardholder’s account.

Xi Other Conditions

If any provisions of the Terms and Conditions become invalid, the remaining provisions will remain in effect until new terms are made or existing ones are amended.

 

The costs of using the internet, phone, and devices for accessing the website are not included in the online store services, and “MARJAN NJEGRIĆ PR ZANATSKA TRGOVINSKA I UGOSTITELJSKA RADNJA COFFEE ROASTING MAN KIKINDA” is not responsible for such costs incurred by the buyer.

 

The seller Is not liable for damages caused to the buyer or third parties due to:

1. Abuse of personal data for ordering products by malicious individuals,

2. Use or misuse of the online store services.

 

For all other matters arising between the seller and the buyer in connection with the online purchase of goods, the provisions of the Law on Obligations, the Law on Electronic Commerce, the Consumer Protection Law, and other applicable regulations shall apply.

 

In case of any disputes, if the seller and buyer cannot resolve them amicably, the competent court in Kikinda will have jurisdiction.

 

The content of the online store “MARJAN NJEGRIĆ PR ZANATSKA TRGOVINSKA I UGOSTITELJSKA RADNJA COFFEE ROASTING MAN KIKINDA” is protected, and the entrepreneur holds exclusive rights to use it.

 

Any commercial use of the content requires the prior consent of the entrepreneur “MARJAN NJEGRIĆ PR ZANATSKA TRGOVINSKA I UGOSTITELJSKA RADNJA COFFEE ROASTING MAN KIKINDA.”

 

The logo of the entrepreneur and the logo used for marking the goods are intellectual property protected by the Intellectual Property Office. Unauthorized use of the logo or any other trademarks is prohibited and may lead to legal actions to protect the entrepreneur and the brand.

 

The Privacy Policy defines the provisions related to the protection of the personal data of the online store users (buyers).
